Ex- FBI Staff Member Claims Unlawful Dismissal Over LGBTQ+ Flag Display

An experienced Federal Bureau of Investigation intelligence specialist has initiated a lawsuit claiming his let go for displaying a Pride flag at his office space.

According to the former employee, that worked in the agency for 16 years, his termination earlier this year was “improper and biased”.

Court Proceedings Alleges First Amendment Infringements

The complaint argues that the FBI breached the employee’s free speech freedoms and initiated disciplinary measures toward him due to engaging in constitutionally covered communication.

The plaintiff is seeking a judicial directive to return his job at the bureau.

Information from the Complaint

The detailed complaint, lodged in a Washington court in the nation’s capital, alleges that the employee was terminated from the Quantico facility last month because of before showing the Pride symbol at his workstation.

According to the document, the LGBTQ+ banner was presented to the plaintiff to acknowledge his work to support the bureau’s inclusion programs.

“From a young age, my only desire was to serve my country and ensure its security alongside the talented and committed individuals of the FBI,” remarked the former employee.

He added, “I displayed that banner – that previously flew in front of the Los Angeles office – not for political reasons, but as a representation of diversity, togetherness and fair treatment.

These principles that once made the bureau effective. Today it has become where individuals such as myself are singled out. I am convinced I was dismissed not because of my person, but rather because of what I represent: an openly gay individual,” he affirmed.

Unexpected Termination Before Completion

Recently, the plaintiff was enrolled in the bureau’s agent training program at Quantico, Virginia, up until what he described as “unexpected firing only weeks prior to finishing”.

The complaint additionally states that at some point following Donald Trump’s inauguration, a co-worker expressed an alleged concern to the overseeing official about the exhibition of the Pride flag.

As a precaution, Maltinsky requested that the legal advisor at the L.A. office examine whether or not the display of the Progress Pride flag was permissible,” the document noted.

It added, The advisor informed the plaintiff that showing of the banner did not violate any bureau guidelines.”

Informing of Termination

Despite this, on the first of October, Maltinsky was informed of his termination.

In correspondence mentioned in the lawsuit, agency head the official wrote, “I have determined that you exercised bad decision-making with the presence of a partisan emblem at your workstation during your previous assignment in Los Angeles.

“Pursuant to federal law of the Constitution, and the laws of the United States, your job with the Federal Bureau of Investigation is now ended.”

Legal Remarks

In comments released this week, his legal representative Kerrie Riggs stated, The current leadership’s wrongful dismissal is a component of a larger campaign to purge public offices of workers with alternative perspectives, or are from minority populations, or who dare oppose bias.

“David’s fight goes beyond his situation, but about securing the liberties and protections of every government worker.”

Department Response

The bureau did not provide a statement about the legal action.

Comparable Legal Cases

The case follows a separate case submitted earlier by previous senior FBI officials who said they’d been unlawfully fired.

They alleged that the official said he had been instructed by the White House to fire any employee involved in an inquiry concerning Donald Trump.

Meanwhile, the bureau terminated an experienced official earlier this month subsequent to Patel reportedly became furious over news that the FBI director had taken an official aircraft to go to a sports event at which his companion sang the anthem.

The veteran, a bureau veteran for over two decades, was dismissed as head of the FBI’s critical incident response group, which manages major security threats and the bureau’s aircraft.
